QuoteA man has been jailed for 18 weeks for sending abusive messages on social networking sites.

Sean Duffy, from Reading, Berkshire, posted hurtful remarks on pages set up in remembrance of girls who had died.

His victims were the bereaved relatives of people he did not know, and included the family of Worcester teenager Natasha MacBryde who killed herself after being bullied.

Duffy pleaded guilty to two counts of sending a communication of an indecent or offensive nature.

Wow.

Okay, the guy is a dick, but do you UKtards have ANYTHING resembling freedom of speech left at all?

Fuck yeah. You're free to get put in jail for saying whatever you like.

We've got something like that too, though not as severe.

The case we had here was of an adult that hounded a 12 year old that had been in an argument with her daughter, pushed all the right buttons on a kid known to be diagnosed as unstable, and the kid killed herself.

No special laws are required to address that.  It's basically 2nd degree murder, or at the very least manslaughter.

But we had to pass "cyberstalking" laws.  For The Children.

Yeah, and they've done little with that law since they passed it and tried to put the woman accused in jail.  Not to mention the woman got off.  Of course she and her family were completely ostracized from their community and probably much of the midwest.  I don't know where they moved, but my understanding is they left within days of the trial being over.  Seems her daughter was catching a lot of shit IRL because of the mom, not to mention their house being picketed, egged, stoned etc.....

You can't convict someone using ipso facto law, at least not yet.  The prosecution used existing law, and did so in a remarkably ineffective manner.

True!!  However, I think the community probably made up for that.  I think she should have been charged with at least manslaughter, but I've said that from day one.

2d degree murder:  A death resulting from an act on the part of another in which the death of the victim was recognizable as a distinct possibility.

It is also sometimes phased:  A reckless indifference to human life that results in the loss of a human life.
