Actually, in a lot of these security tracking programs that is a standard feature and it has caught a number of thieves. However, using it to spy on children is probably not a purpose the programmers had in mind.

They probably weren't left open and on ALL the time, but a lot of people, including me, will get up and take breaks from the computer without shutting it down, or will leave a chat program open while I do other stuff, or go get something to eat. And, honestly, I have never thought twice about using my laptop in bed, or computing in my underwear. Or buck naked, in the summers.

Its possible the school in question hasn't spied on kids with the stuff, but there have been a few documentaries (including one mentioned in your link) where administrators in other parts of the country admit that they did that.

As far as I understand, disabling the camera by software means was grounds for expulsion, basically because they didn't want students to mess with the software/system on the laptops. But covering the camera with a piece of tape was not, as long as it did not damage the laptop. In fact in one of the comments I read some students did in fact just that, but were considered "paranoids" :)
As for problems with black background, you can fix that easily, works great for a lot of sites. In Firefox you select View > Page Style > No Style or in Opera it's View > Style > User mode (or shortcut Shift-G, though in the Style menu you can also pick other styles, you might like High contrast B/W too, as it keeps most of the page layout but just changes the colours to black text white background). If you use Safari, I don't know but try looking for some menu option mentioning "Style" or "Stylesheet". It also works great for websites that try to prevent you from saving images, such as Flickr, because it messes up something in the right-click prevention code.
I don't mind white text on black background. Shoot, I'm using that theme on here.

I still cover the camera on my laptop unless I have phyically disconnected from all network cables, disabled the wireless adapter and am not doing around. I also usually try to disable the built in microphone, and I am usually booted into something other than the windows shit that it came installed with, so while the chances are very small that any of it will be used without my knowledge, I still try to take precautions.
I rarely turn off or reboot my computers unless they auto-hibernate or I am relocating them, or if I have installed something or for some other reason NEED to reboot.

The LANrev software program took screen shots and webcam photos every 15 seconds when activated. The district thereby captured over 400 screen shots and webcam images of Harriton High School sophomore Blake Robbins, according to court filings this week in his lawsuit.
The suit, filed in February, exposed the tracking program and prompted an FBI investigation into possible wiretap violations, along with debate among parents about whether to support the potential class-action lawsuit.
"A substantial number of webcam photos have been recovered in the investigation," school board President David Ebby said in a statement Friday. "As we have made clear since day one, we are committed to providing all of the facts — good and bad — at the conclusion of the investigation."
Quote"Thousands of webcam pictures and screen shots have been taken of numerous other students in their homes, many of which never reported their laptops lost or missing," Haltzman wrote in a motion filed Thursday.
According to Haltzman, technology coordinator Carol Cafiero refused to answer his questions at a recent deposition, citing her Fifth Amendment right against self-incrimination. She and technician Michael Perbix were the only employees authorized to activate the webcams. Perbix did not fight the deposition.
Haltzman called Cafiero a possible "voyeur" and wants access to her personal computer to see if she downloaded any student images. To support the charge, he cited her response to an e-mail from a colleague who said viewing the webcam pictures was like watching "a little LMSD soap opera."
"I know, I love it!" Cafiero allegedly replied.
Would be interested to hear what the parents who opposed the lawsuit have to say for themselves now.
They're probably pissed that their kids aren't getting photographed that often.

It does look like the judge in the case takes this seriously, they've been ordered to stop doing it.
