"There is a problem with both groups accepting a child from such a marriage," Bardwell said. "I think those children suffer and I won't help put them through it."

If he did an interracial marriage for one couple, he must do the same for all, he said.

"I try to treat everyone equally," he said.

Bardwell estimates that he has refused to marry about four couples during his career, all in the past 2 1/2 years.

Beth Humphrey, 30, and 32-year-old Terence McKay, both of Hammond, say they will consult the U.S. Justice Department about filing a discrimination complaint.

Humphrey, an account manager for a marketing firm, said she and McKay, a welder, just returned to Louisiana. She plans to enroll in the University of New Orleans to pursue a masters degree in minority politics.

"That was one thing that made this so unbelievable," she said. "It's not something you expect in this day and age."

Humphrey said she called Bardwell on Oct. 6 to inquire about getting a marriage license signed. She says Bardwell's wife told her that Bardwell will not sign marriage licenses for interracial couples. Bardwell suggested the couple go to another justice of the peace in the parish who agreed to marry them.

"We are looking forward to having children," Humphrey said. "And all our friends and co-workers have been very supportive. Except for this, we're typical happy newlyweds."

"It is really astonishing and disappointing to see this come up in 2009," said American Civil Liberties Union of Louisiana attorney Katie Schwartzmann. "The Supreme Court ruled as far back as 1963 that the government cannot tell people who they can and cannot marry."

The ACLU sent a letter to the Louisiana Judiciary Committee, which oversees the state justices of the peace, asking them to investigate Bardwell and recommending "the most severe sanctions available, because such blatant bigotry poses a substantial threat of serious harm to the administration of justice."

"He knew he was breaking the law, but continued to do it," Schwartzmann said.

According to the clerk of court's office, application for a marriage license must be made three days before the ceremony because there is a 72-hour waiting period. The applicants are asked if they have previously been married. If so, they must show how the marriage ended, such as divorce.

Other than that, all they need is a birth certificate and Social Security card.

The license fee is $35, and the license must be signed by a Louisiana minister, justice of the peace or judge. The original is returned to the clerk's office.

"I've been a justice of the peace for 34 years and I don't think I've mistreated anybody," Bardwell said. "I've made some mistakes, but you have too. I didn't tell this couple they couldn't get married. I just told them I wouldn't do it.

What decade does he live in? I remember when I was a kid being self-conscious because it was all over the TV how hard it is for mixed-race kids. Then I looked around my neighborhood and realized that most of the kids were mixed... and it hasn't bothered me since, what, 1979?

I read this earlier, on the news sites and I was completely un-surprised.  It's the South and these people will make up their laws as they go in many cases.  You can't fight them unless you get someone else with some clout to fight for you.  I live near Talladega and have seen outstanding lawyers turn down cases because the Talladega county courts play the gane by their rules.  This case seems to be the same kind of thing, but since it's racially motivated, is willing to get involved.

Rodriguez said Sturgis took her pictures over the summer instead of with the other students last year, but she used the same studio.

In August, Rodriguez said she received a letter from the school stating that only boys could wear tuxedos. Rodriguez said she met with assistant Superintendent Ronald Holloway who told her he didn't see regulations about the issue in the student handbook.

But when she talked with Greer, she said he told her it was his "conviction" that Sturgis wouldn't appear in the yearbook in a tuxedo.

Bennett said the teenager's constitutional rights are being violated. Bennett said similar cases, including same-sex prom couples and girls wearing tuxedos to proms, have been successfully challenged in court in other states. ACLU officials said they were unaware of any other constitutional disputes involving gay teens at Mississippi schools.

"You can't discriminate against somebody because they're not masculine enough or because they're not feminine enough. She's making an expression of her sexual orientation through this picture and that invokes First Amendment protection," Bennett said.

There's no state policy that deals with the yearbook photo issue, said state Department of Education spokesman Pete Smith.

The deadline for the photo to be accepted for the yearbook was Sept. 30. But advertisements for the publication are still being taken so Sturgis has time for her photo to be included, Bennett said.

Sturgis lives with her grandparents in Wesson, a town of about 1,700 founded during the Civil War in southwest Mississippi. The town's Web site said residents "pride ourselves on our quiet way of life."

So this shit in the OP, fucked up 6 ways to Sunday, but knowing how it is over there as I do (I've argued my own KIN to the ground about the difference between blacks and whites)...yeah...it's near-impossible to fight some of that prejudice.  I won't even get into the sort of shit I went through marrying an Afghan in my own family.  That was...painful, to say the least.

I admired Verthaine, but something kinda wicked, gross, and cowardly came through me that time I threw up a racial slur at him in his 'getting married to a white woman and fuck anyone who calls me a nigger' thread.  Don't know what possessed me.  That was last time I've ever seen him on the nets, even though I searched a few times out of curiosity.  I left this place for a long time after that too.  I hate getting on peoples' nerves who don't deserve it.  I am a nerd sometimes.

And I think it is safe to tell someone who says the thing about the Japanese, that the Geisha existed long before whites vistied them, and the paint covered all but the back of the neck.  The reason for that small patch to be bare was that it was supposed to be a very arousing and erogenous zone.  They have always preferred to be fair because to maintain a fair complexion meant that they were not commoners.  Only the commoners worked the fields and got tanned while the aristocracy could remain out of the sun.  It was a sign of distinction which was also found in Europe, so it is more of an aristocratic thing than a white thing. 

All that said, I realize that it means absofragginlutely nothing to someone who wishes to believe otherwise.  but its almost 0400 here and it was the first cognitive thought I have had since the last fire emergency we had.

The ACLU sent a letter to the Louisiana Judiciary Committee, which oversees the state justices of the peace, asking them to investigate Bardwell and recommending "the most severe sanctions available, because such blatant bigotry poses a substantial threat of serious harm to the administration of justice."

"He knew he was breaking the law, but continued to do it," Schwartzmann said.

According to the clerk of court's office, application for a marriage license must be made three days before the ceremony because there is a 72-hour waiting period. The applicants are asked if they have previously been married. If so, they must show how the marriage ended, such as divorce.

Other than that, all they need is a birth certificate and Social Security card.

The license fee is $35, and the license must be signed by a Louisiana minister, justice of the peace or judge. The original is returned to the clerk's office.

"I've been a justice of the peace for 34 years and I don't think I've mistreated anybody," Bardwell said. "I've made some mistakes, but you have too. I didn't tell this couple they couldn't get married. I just told them I wouldn't do it.

I can't even begin to tell you how many kids at my childrens' school are mixed-race. Or how many kids I see with a white parent and a black parent when I'm out and about. I mean, one of my friend's kids said "Mom, why is Nigel black, and EFO is black, but MO and LO are white?" and she said "Because their mom is black and their dad is white, so some of the kids turned out black and some white" and they said "Oh, cool, I get it". The lesson being, NOBODY FUCKING CARES unless some asshole makes a big deal about it.

Fuck, look at kindergarteners. They are so fascinated by how people are different colors, the same way they are fascinated by EVERYTHING IN THE WORLD. Tell them that people come in different colors, and their reaction is "Oh". And then they want to go draw pictures and play, same as they always do. And they draw their friends in different colors, and they tell you how their friends are different, just  like they would with anything. Kids don't fucking care. The world is awesome to them, and the fact that their friend Sarah is dark brown and their friend Kurt is light brown is just another thing they can do with color crayons.

"In order to improve our understanding of others, we need to learn," said Alvaro Watson of Purpose, the student group. "We can't fight for something if we only know one side."
Before his remarks at Temple, a public university serving about 34,000 students, Wilders showed his 15-minute anti-Islam film, "Fitna," which juxtaposes passages from the suras, or chapters, of the Quran with images of the Sept. 11 terrorist attacks, beheadings, shootings and speeches from clerics advocating violence against non-Muslims.
"I think it's completely wrong that someone who promotes racism and intolerance should be given a platform at this university," said Temple student Josh Rosenthal. "It's hate speech disguised as free speech."
Another student, Joseph Rodrigues, said that being able to voice unpopular opinions is a freedom not to be taken lightly. "I might not like what he said, but I think it's important that he be allowed to say it," he said.
Temple officials issued a statement saying the university "is a community of scholars in which freedom of inquiry and freedom of expression are valued."
"We respect the right of our student organizations to invite people who express a wide variety of views and ideas," the school said in a statement.
British officials once banned Wilders from visiting for fear it would spark violence. He successfully sued the government and visited Friday.
