yeah, this deserves a standalone thread.
You're damn right it does!
Techno Viking is an Internet cultural treasure. This lawsuit makes me sad.
I don't understand what he's suing for. It's video taken in a public place. :?
My guess - he's suing cos loads and loads of filthy lucre.
He could raise an army with that kind of money. He could take to the sea in longboats and rape and pillage and do the big box / little box dance

I mean his legal standing for the lawsuit.
I'd guess it's based on the film-maker making cash from his image and wanting a cut.
He must have had a shit time lately, it's not like he can claim to have only just heard about this now.
Speculation - He later ended up with an X habit, recently fired and is reacting by suing the internet.
Defamation of character. It makes him look to weak and unmanly. Had the video showed him beating in the skulls of small, peaceful villagers who happen to be rich in livestock and poor in weaponry this would be a whole different story.
Perhaps its effected his sex life.

So if you read one of your poems in a public place and someone takes some video of it and makes a ton of money off of it, they owe you nothing?
THIS THREAD IS NOW ABOUT DRUGS INTELLECTUAL PROPERTY LAWS.
30 PAGES.

Yes.
If I'm on a streetcorner reading poetry and someone videos it, the video is their copyright. There might be issues with the audio portion, depending on the state.
Mind you, I'm not asking about the ideal situation, I'm asking about the actual situation. So far, as far as I know, photos and videos are the legal intellectual property of the person who created them, provided they were taken legally. Of course, maybe the laws are different in vikingland, which is why I asked what his legal basis for the lawsuit is.
In vikingland the court generally settles on the side of the person carrying the largest axe
Technoviking has a good solid case

"Personality infringement" makes me sad. :(
Yeah, me too. This lawsuit sucks. Oh techno Viking, how he have fallen.

I don't think it's that black and white.
Ok, how about if you display a painting at Last Thursday on the street, I take a photograph of it, and I make a lot of money selling the prints—without ever mentioning that you painted it.

That's making an illegal copy of a copyrighted work. However, if the picture was not a close-up of the painting but a picture of the vendor's booth that included the picture, it would be your photograph to sell as you wish.
Are you seriously going to argue copyright law with me because I asked what the legal basis of Technoviking's lawsuit is? All that tells me is that you don't know.
Luckily, the article Waffles posted had the answer, which is that he's suing for "personality infringement".
Personality infringement's an interesting one. As far as I can see, the law has mostly been applied by celebrities to protect their likeness from being used to make money via art based on their appearance, or their likeness appearing to promote a company's product.
Usually, the company in question prefers to settle out of court than go through case proceedings. As a consequence, it's not entirely clear as to where the limits of personality infringement laws actually lie.

It'll be really interesting to see where this goes. If he wins, the ramifications are a little staggering.
So, if some celebrity were to release a picture, or, say, a 3D laser scan of themselves into the public domain, with the general instructions to, basically, do as thou wilt, and you start selling stuff on Etsy using their image, and then either they, or their company decide they don't like what you're doing...
Then what?

So, what if there is an angry unicorn on the dark side of the moon, and astronauts disturb it, and it files a complaint with NASA, and NASA doesn't care for it...
Then what?

If there's one thing RWHN's right about, it's that pot makes people say really stupid ideas out loud.

Update:
QuoteFilmmaker Matthias Fritsch shot a video that became a viral hit, known as "Technoviking". For the last three years, he's been battling the protagonist over "personality rights". He's now raising funds on Indiegogo to make a documentary about the ordeal.
http://www.wired.co.uk/news/archive/2013-06/27/technoviking
Quote"I tried to find a compromise, but they didn't even move a tiny step," he says.
After three years of wrangling, a decision was reached in court: Fritsch was forced to agree to only use the video if he manipulates the images in such a way that he can't be identified. Despite this, there's a sense that the horse has very much bolted. Fritsch might have been gagged, but there are hundreds of other artists who have made derivative works that will remain online. "It's too late. That's the whole absurdity of the trial."
In addition to censoring the video, Fritsch must pay the plaintiff €8,000 -- the vast majority of the money he made from the video. That's on top of the €7,000 in legal bills. He says that the trial will bankrupt him. "I haven't had the bill yet. The final letter came on 10 June," he says, despondently.
"In my artistic practice I don't focus too much on commercially marketing my content. I'm interested in free culture and I'm always financially on the edge. €15,000 is what I need for two years of living. It puts me in a very difficult position."
Yeah fuck bankers and the governments who regulate them, Techno Viking is a symbol of Righteousness and Justice against the guy who lives on €7,500 per annum.
Well done, Techno Viking, well done.

That is so unfortunate.
Especially given that Technoviking could have easily used the viral video's fame to lauch his own series of creative projects, and probably made a lot more money.
