Title: Redskins' Trademark Revoked!!!
Post by: Roly Poly Oly-Garch on June 18, 2014, 03:30:27 PM
QuoteWASHINGTON -- The U.S. Patent Office has ruled the Washington Redskins nickname is "disparaging of Native Americans'' and that the team's federal trademarks for the name must be canceled.

http://espn.go.com/nfl/story/_/id/11102096/us-patent-office-cancels-washington-redskins-trademark (http://espn.go.com/nfl/story/_/id/11102096/us-patent-office-cancels-washington-redskins-trademark)

This is the second time the patent office has ruled this way. The first time was thrown out on procedural grounds, though. The upshot is if the Washington (American) football team insists on keeping their name they lose exclusive merchandising rights. The decision can be appealed but the process of appeal in administrative law is very limited (will probably never find its way to a federal court, for instance).

Be very interesting to see how much that "honorable and glorious tradition" team owner, Dan Snyder, is always crowing about will mean to him when his brand basically becomes public domain.

Also, here's the Onion's take:

QuoteWASHINGTON—Denying widespread claims that the franchise is being offensive or disrespectful, the Washington Redskins' kike owner announced Monday that he remains steadfast in his refusal to change the team's derogatory name. "The Redskins represent 81 years of great history and tradition, and it's a source of pride for our fans," said the hook-nosed kike, stressing that the team's insulting moniker is "absolutely not a racial slur by any means." "'Washington Redskins' is much more than just a name. It stands for strength, courage, and respect—the very values that are so intrinsic to Native American culture." The shifty-eyed hebe went on to assure fans that he will do "everything in his power" to preserve the team's proud heritage.

One more tiny step toward convincing white Americans that American indians are actual people.

There's ways to do this respectfully. Florida State has permission from the Seminole Nation to have the Seminoles as their mascot, AND have a Seminole portray Osceola as their "mascot" during games, which is actually more of a ceremony for anyone who has ever seen how they open football games.  Pretty sure the Chicago Blackhawks also have permission, but you're also using the name of a nation, not a pejorative.

My guess is that Cleveland Indians is next.

Doubt it. This was a symbolic issue. The outrage machine, however justified in this case, doesnt deal in actual change, only in ratings. The problem most American Indians face isnt sports mascots, its crippling poverty, drug addiction and a lack of healthcare. Currently reservations have an infant mortality rate double that of the rest of America. You cant tweet a problem like that away, and more importantly, theres no bad guy to feel morally superior too. The media will move on to a new target and most of America will forget that Indians even exist.

I like how not being able to maintain franchise of a brazenly racist team name and mascot is somehow enough of a real problem for them to have grit in their panties over it.

The bitching comes in peaks and valleys whenever the subject becomes brought up by the media again.

The worst part is that the way they see it, the name is acceptable because it's part of their "football tradition".

Hey Raz, send this to your squabbling coworkers. It's an article from December explaining the etymology of the word "redskin" with sources!

It's also interesting to see how it may not have started as a pejorative, but certainly is now. I love etymology, it's always so fascinating.

The best part about this approach is that there's absolutely no legitimate "OMG MY RIGHTZ!!!" argument to be made. They can hold on to the name if they want...they just lose trademark protections. Once If this clears appeals, the Redskins can carry on with their stubbornly racist name if they want, it's just that you and I can put that name and logo on anything we want and sell it without penalty.

And any "THEY TOOKED HIS PROPERTIEZ!!!!" is bunk, too, since this decision doesn't take anything...it just stops giving it. I've already had occasion to draw the parallel to "entitlement programs" in FB arguments on the topic.

"Oh, really? So you think that there shouldn't be standards for withholding government benefits from people who abuse them?"

The funny thing is, I don't consider it a pejorative, I simply think that naming a sports team after a race and having as a mascot an exaggerated caricature of that race is, well, racist as hell.

It would be racist regardless of which race the team was named after. It just fucking is. What if they were called the Whiteys, and they had a caricature of a white man for their mascot? THAT'S FUCKING RACIST.

Having a discussion on FB (ugh) about the Fightin' Irish versus the Orangemen. Same idea.

The NCAA forced Syracuse to drop it to just "The Orange" which is still kind of the same thing, yet nobody seems to bat an eye at Notre Dame. Really?

It's hard to lean on a traditionally Irish Catholic university that want's to call itself the "Fighting Irish". Strange choice, imo, but kind of a different deal than just completely appropriating the imagery of another culture entirely. One is kind of just....really??? The other is getting more into the minstrelsy area.

And I totally had to google orangemen to get the reference there at all. Apparently the NCAA just made them drop the 'men' to get in line with the spirit of Title IX.

The trademark to the Redskins' current logo wasn't revoked, but the ruling sets precedent that will make it very easy for the rest of their trademarks to be revoked if they're challenged in court, which seems probable.

I think the public having the ability to market "Washington Redskins Brand Tunnel Plugs"  or better yet "Washington Redskins Brand Santorum Clean-Up Wipes," may present a sufficient challenge to keeping the name.

Native americans have it way too easy in this country. They get to live on these sweet reservations, and their decimated culture gets to be represented by a cartoonish caricature. Can't they see that we've commercialized their heritage and made it into a commodity out of RESPECT?

It's so disturbing that the one time an organ of the US Government has done anything to defend the culture they conquered, eradicated, and systemically oppressed for centuries, all these white people jump up like WOAH WOAH WOAH THAT'S NOT FAIR

You read about the Trail of Tears and Wounded Knee and you assume that kind of thing is in the past. You assume we got better. Nope! As a collective, we still don't give a shit about the Native Americans. Can they just shut up and go away please? They're ruining sports.

I'd normally hesitate to put sectarian hatred on the same level as Nazism in terms of ideological abhorrence...but I'm willing to make that exception for the Orange Order and its supporters (who, coincidentally, are also very friendly with actual Nazis (http://www.newsletter.co.uk/news/regional/orange-order-in-bnp-link-1-1845881)).  If you wonder where, apart from the offices of MI5, the Loyalist terrorists in Northern Ireland got their weapons and had such influential backing...well, that's your answer.

From what I understand, much like ND being a Catholic university, Syracuse was at one time protestant, but no longer identifies itself with being a religious institution and hasn't for quite some time. I have no idea if they actually had any connection whatsoever to the Orange Order, but they seem to have moved pretty fast from have a nondescript logo and mascot into having an actual orange show up more than just as Otto the mascot, which is bizarre, but I suppose they want to cover their tracks as to not be affiliated with an Irish hate group, because there's a good chance not many people had a damn clue. It's not something you hear about in the US that often.

Not to mention most American sympathies are with the Republicans, especially in the Irish community.  Openly advertising your loyalist, Protestant supremacist credentials openly would probably cause a LOT of negative comment and backlash, even post 9-11.

You read about the Trail of Tears and Wounded Knee and you assume that kind of thing is in the past. You assume we got better. Nope! As a collective, we still don't give a shit about the Native Americans. Can they just shut up and go away please? They're ruining sports.

Yeah, it gives me a true sense of horrormirth, as in I'm laughing at it but really it's NOT FUNNY AT ALL IN FACT IT HURTS INSIDE.

Hey Raz, send this to your squabbling coworkers. It's an article from December explaining the etymology of the word "redskin" with sources!

It's also interesting to see how it may not have started as a pejorative, but certainly is now. I love etymology, it's always so fascinating.

http://www.slate.com/blogs/lexicon_valley/2013/12/18/redskins_the_debate_over_the_washington_football_team_s_name_incorrectly.html

Thank you for that, it was an interesting read.
Unfortunately, my co-workers are now even more confident that they have every right to use the term, because Indians are the ones who made it up.  It's akin to "no I've got a black friend, it's cool" logic.

What I keep hearing over and over "where does it stop?" and "what's next?" It seems a really weird thing to apply a slippery slope argument against THE PRESSURE TO FUCKING EVOLVE!

It's like, "Where do we draw the line??? WHERE??? Why if we're not careful, we'll not only be a little better tomorrow than we are today...WE COULD END UP A WHOLE FUCK-LOAD BETTER A WEEK FROM NOW!"

This is somehow a dangerous undertaking?

What's next, the Nordics demanding the Vikings Change their name? Bengal tigers demanding to be treated with respect and dignity? Christians spouting off about how Magic is bad for the kids? This is a fucking joke. There is no end game here. Soon every team will be without a mascot, that's where this is headed. Chalk this one up to the Pussification of America.

Come to Minnesota. Watch them sit on their ass whilst their pockets get fat off casino money. Take a walk through Cass Lake, an area that at one time had one of the highest murder rates in the United States. See the hate in their eye for every white man, even the ones who have done nothing to them or their ancestors. Put on one of your fancy fedoras and walk down the "street" there, then see how long until you get jumped and most likely stabbed to death. Then maybe you will have a real opinion.

The natives control 18 casinos in Minnesota alone, raking in billions of dollars every year. IMO, they have been repaid 1000 fold. I'm sick of their whining, especially over something as simple as a mascot, that should be taken as a sign of respect. Oh, I'm also sick of their general, you know, racist attitude towards everything that isn't, you know, "Native American."
