EOT, you're missing a fine point of the law, here.

If an Hispanic is pulled over and doesn't have ID (even if he isn't the driver), he is guilty of the misdemeanor, even if he is a citizen or legal resident.  IE, he can be released from detainment upon proof of legality, but is still guilty under this law of not having the ID on his person.
