In this case, looks like they likely can't.  They were responding after the major cases were taken to the hospital to deal with the less injured.  He quit before they could fire his ass.

Probably took a month for the FoI request to get processed.  Hell, I think they're STILL waiting for some information requests from when Palin was governor to be released.

Probably less of a deal considering that the guy was off the job before the stuff could go to press.  No reason to rush to spin up the outrage to get him fired, he'd already retired.
