Title: Mrs Smith goes to Texas
Post by: LMNO on June 26, 2013, 06:59:57 PM
http://www.washingtonpost.com/politics/after-wendy-daviss-filibuster-texas-abortion-bill-misses-deadline/2013/06/26/b76fd2a8-de68-11e2-b797-cbd4cb13f9c6_story.html

QuoteLawmakers in Texas failed to approve a stringent new abortion law in advance of a midnight deadline Tuesday night after chaotic protests and an 11-hour filibuster by state Sen. Wendy Davis.

I must say, I was sucked in by this one.  Stayed up until 1:30 following various tweets and FB updates, and newsbloggers.  I especially like the part where the GOP decided it wasn't 12:06 when they put it to a vote, but rather 11:66.  Interesting to have a bunch of state senators committing fraud and abuse of power in "front" of 180,000 spectators.

But this morning, I (along with being very, very tired) felt vaguely let down.  I was part of the spectacle; and judging by how things went down in Wisconsin, there will eventually be another bill, or vote, or some such asshattery bullshit that will shut down abortion clinics in TX.  I really did feel the mob hype.  I was awed, elated, furious, and then... nothing much.

Wendy Davis was very impressive, staying standing and talking for 11 hours to a hostile and abusive senate. And there have been a few good memequotes you'll be seeing on FB for the next few weeks.  But was it truly successful, or did we just stave off the inevitable for another six months?

To that last question:

I have a renewed sense of hope. I don't know what it is, but there seems to be more people willing to do this, to literally take a stand for what's right. I can't remember her name, but the one who wrote that letter RE: banksters.

Just these two women alone give my cynical heart a glimmer of hope.
I think it may just be a matter of time. Eventually these old, stupid bastards will die, and yes their children will continue their great work, but not all of them. And maybe less and less with each generation.

So there's a light at the end of the tunnel. I think. It just happens to be the sun, which, you know....

"Optical illusion.  The tunnel is a well, and you're looking up from the bottom."

The above line, spoken to my boss, had interesting results.

It's a baby step, but I can't imagine they're going to let that kind of a filibuster happen again. The old rich white men will get their way somehow.

In the meantime, that woman needs to run for governor.

Politics never ends.  There is no eternal victory, no final state of perfection which can be achieved.

Of course the Republicans are going to try and smuggle another bill in.  Of course the Democrats will attempt to fillibuster it.  Of course this will go round and round in circles, probably without resolution, as the problem is not one of technical efficiency or scientific knowledge, but one of ethics and morality, and so open to endless interpretation and debate.  Maybe one day in the future, there will be enough people to make abortion a constitutional right.  Or maybe to ban it, constitutionally.  But even then, it will be contested, just like the constant attempts to chip away at the 2nd and 4th amendments.

You can't ever win, you can only hope to stave off defeat for another day.

We had an OK governor here once. The Bush campaign started a rumor that she was a lesbian.
You know, like high school bullshit. That's all it took.

NEWSFLASH: Texas is fucking hopeless, Ann Richards couldn't fix it, Wendy Davis isn't gonna fix it, it's NEVER GOING TO GET BETTER.
I'd like to see Wendy get elected anyway, though, just to watch these guys have a series of aneurysms.

Not sure how the fuck that's legal.

They tried to touch abortions last year in Rhode Island.

Once.

That woman who brought up the ultrasound bill disappeared from the General Assembly. It took one protest and she was forced to resign. Then she disappeared from the state entirely. You do NOT fuck with rights up here................................

........except for guns, but that's mostly Massachusetts. We don't talk about those people. Or Texas North. (NH.) But at least NH has gay marriage and legal, safe abortions.

The state of Texas is turning down billions of federal dollars that would have paid for health care coverage for 1.5 million poor Texans.
By refusing to participate in Medicaid expansion, which is part of the Affordable Care Act, the state will leave on the table an estimated $100 billion over the next decade.

Texas' share of the cost would have been just 7 percent of the total, but for Gov. Rick Perry and the state's Republican-dominated Legislature, even $1 in the name of "Obamacare" was a dollar too much.

...Yeah, I can just feel the LOVE.

The morons in my statehouse are one of the things that I can't fix and that really piss me off.

This. Anyone care to take a shot at explaining how exactly filibustering is democratic? It got used for good here, but as has been noted it has and will be again used to do at least as much harm.

I guess both sides see it as an integral part of the system regardless. Just sounds like screaming long enough until you get what you want to me.

Hey Cain,

QuoteYou can't ever win, you can only hope to stave off defeat for another day.

Upbeat mood for the moment, but I'm not sure about this. I guess it depends on what you call "winning". If you're debating the same issues repeatedly, then yeah, that's not a win. How about when you get what you want and then move the debate forward? I'd say the civil rights movement would be a good example here. It's not perfect but coming out as straight up racist now will alienate more voters (generally) than it will gain you. Net result would be that the change is accepted as a new norm.

I'm thinking the trick is to always keep pushing, and push big. Seems to make it easier to hold political gains?

I know I'm wrong here somewhere, just not sure where or why.

What bugs me about this is that the reason Roe Vs Wade was even enacted into law was that folks were getting abortions anyway and the results were fucking horrific.

you can't make abortion go away. you just make it more dangerous. And damned if those "pro-life" nuts would help kids orphaned by their moms who cannot afford another kid having an unsafe abortion, or actually giving out free contraception, or sex ed that works to prevent abortion.

you can't make abortion go away. you just make it more dangerous. And damned if those "pro-life" nuts would help kids orphaned by their moms who cannot afford another kid having an unsafe abortion, or actually giving out free contraception, or sex ed that works to prevent abortion.

fucking assholes.

The whole point here, Pixie, isn't about the act of abortion.

It's about punishing you dirty, dirty womenfolk for having sex all unregulated and shit.  This is one of two reasons they oppose contraception, as well.

The other reason is that they assume that teenagers will be fucking until they get speed burns, if contraception is made available.  Sort of like how they started butt-chugging by the millions, etc, etc.

But it's mostly the punishment thing.  They WANT women to die in botched abortions, because you're DIRTY AND WRONG because you have bits.

What?

It's the basic drugs arguement.  People are going to do it anyways, making it illegal only makes it dangerous and causes more people to be harmed.

Unfortunately it is a sort of logic that the government seems to be sorely lacking which is why abortion was legalized based on a constitutional right to privacy, not to protect the safety of women.

Well, I'm trying to not go all pedantic on his ass.

Roe v Wade was not based on the right to privacy.  It was based on amendment IX.
Title: Re: Mrs Smith goes to Texas
Post by: Doktor Howl on June 28, 2013, 07:15:32 PM
Retracting that.  Amendment IX was argued but declined.  It was covered under amendment XIV, equal protection under law.  Privacy was the issue, but not the legal decision.
Title: Re: Mrs Smith goes to Texas
Post by: Pergamos on June 28, 2013, 07:16:31 PM
Amendment XIV according to wikipedia.  It's not the right against search and seizure, but it is still a right to privacy.  Specifically arising from the due process clause.

Here's the specific quote concerning the 9th amendment, which had been the rationale for a lower court's decision.
Quote
"The Court declined to adopt the district court's Ninth Amendment rationale, and instead asserted that the "right of privacy, whether it be founded in the Fourteenth Amendment's concept of personal liberty and restrictions upon state action, as we feel it is, or, as the district court determined, in the Ninth Amendment's reservation of rights to the people, is broad enough to encompass a woman's decision whether or not to terminate her pregnancy."[23] Douglas, in his concurring opinion in the companion case Doe v. Bolton, stated more emphatically that, "The Ninth Amendment obviously does not create federally enforceable rights."

Pergamos, I would argue that the safety/health argument, while not invoked in the Supreme Court ruling, worked tremendously to shift public opinion in the case of abortion, much as it has also done for drug decriminalization.

If you are seriously arguing a lack of shift in public opinion over the last few decades, I can only wonder what drugs you are on...
